1. A bill concerning conscientious and
  2. philosophical exemptions to preK-12 school and
  3. daycare entry vaccination requirements,
  4. amending Chapter  1003.22(5)(a)F.S., and
  5. providing an effective date.
  6.  
  7.      WHEREAS, despite public and government
  8. assumed confidence, there is substantial
  9. scientific and medical debate regarding
  10. the effectiveness of vaccines, and
  11.  
  12.      WHEREAS, in the U.S. Congressional Hearings
  13. regarding concerns over vaccine safety(1999-
  14. 2004), there were disclosures of major
  15. deficiencies in the scientific infrastructure,
  16. and safety testing of today's childhood
  17. vaccines, indicating unequivocally that
  18. vaccination includes degrees of medical risk,
  19. and
  20.  
  21.      WHEREAS, the States of Arizona, Arkansas,
  22. California, Colorado, Idaho, Louisiana, Maine,
  23. Michigan, Minnesota, New Mexico, North Dakota,
  24. Ohio, Oklahoma, Texas, Utah, Vermont,
  25. Washington, and Wisconsin all allow
  26. philosophical exemptions to their school
  27. entry vaccination requirements, and none
  28. of these States have reported a resurgence
  29. of diseases for which there are vaccines, and
  30.  
  31.      WHEREAS, the acceptance or non-acceptance
  32. of the foregoing neither enhances nor
  33. diminishes the responsibility of the State of
  34. Florida to protect the human and civil rights
  35. of its residents. Among those rights being:
  36. freedom of personal choice in healthcare,
  37. the right of personal sovereignty over one’s own
  38. body, and the right of parents and legal
  39. guardians to execute their responsibility to
  40. protect those rights of their children, or of
  41. those in their guardianship, NOW THEREFORE,
  42.  
  43. be it enacted by the legislature of the State
  44. of Florida:
  45.  
  46.      Section 1.   Item(a) of subsection (5),
  47. Chapter 1003.22 Florida Statutes, is amended to
  48. read:
  49.  
  50. 1003.22 School-entry examinations; immunization
  51. against communicable diseases; exemptions;
  52. duties of Department of Health.--
  53.  
  54. (5)The provisions of this section shall not
  55. apply if:
  56. (a) The parent of the child objects in writing
  57. that the administration of immunizing agents
  58. conflicts with his or her religious tenets or
  59. practices vaccines conflicts with his or her
  60. religious, or philosophical tenets or practices,
  61. or that it conflicts with his or her considered
  62. choice in healthcare.
  63.      Section 2.   This act shall take effect
  64. immediately on becoming a law.
