- A bill concerning conscientious and
- philosophical exemptions to preK-12 school and
- daycare entry vaccination requirements,
- amending Chapter 1003.22(5)(a)F.S., and
- providing an effective date.

- WHEREAS, despite public and government
- assumed confidence, there is substantial
- scientific and medical debate regarding
- the effectiveness of vaccines, and
-
- WHEREAS, in the U.S. Congressional Hearings
- regarding concerns over vaccine safety(1999-
- 2004), there were disclosures of major
- deficiencies in the scientific infrastructure,
- and safety testing of today's childhood
- vaccines, indicating unequivocally that
- vaccination includes degrees of medical risk,
- and
-
- WHEREAS, the States of Arizona, Arkansas,
- California, Colorado, Idaho, Louisiana, Maine,
- Michigan, Minnesota, New Mexico, North Dakota,
- Ohio, Oklahoma, Texas, Utah, Vermont,
- Washington, and Wisconsin all allow
- philosophical exemptions to their school
- entry vaccination requirements, and none
- of these States have reported a resurgence
- of diseases for which there are vaccines, and
-
- WHEREAS, the acceptance or non-acceptance
- of the foregoing neither enhances nor
- diminishes the responsibility of the State of
- Florida to protect the human and civil rights
- of its residents. Among those rights being:
- freedom of personal choice in healthcare,
- the right of personal sovereignty over one’s own
- body, and the right of parents and legal
- guardians to execute their responsibility to
- protect those rights of their children, or of
- those in their guardianship, NOW THEREFORE,

- be it enacted by the legislature of the State
- of Florida:

- Section 1. Item(a) of subsection (5),
- Chapter 1003.22 Florida Statutes, is amended to
- read:

- 1003.22 School-entry examinations; immunization
- against communicable diseases; exemptions;
- duties of Department of Health.--

- (5)The provisions of this section shall not
- apply if:
- (a) The parent of the child objects in writing
- that the administration of
immunizing agents
conflicts with his or her religious tenets or
practices vaccines conflicts with his or her
- religious, or philosophical tenets or practices,
- or that it conflicts with his or her considered
- choice in healthcare.
- Section 2. This act shall take effect
- immediately on becoming a law.
